Terms of Service

1. Services
Certified Tree Service provides professional tree care services including tree removal, tree pruning, stump grinding, and land clearing across the Central Coast, Newcastle, and Sydney regions of New South Wales, Australia. All services are performed by qualified personnel under the supervision of an AQF Level 3 certified arborist.
2. Quotes and Agreements
All quotes provided by Certified Tree Service are valid for 30 days from the date of issue unless otherwise stated. Quotes are based on the conditions observed at the time of assessment. If site conditions change significantly between the quote and the scheduled work date, we reserve the right to revise the quote accordingly.
Acceptance of a quote — whether verbal, written, or electronic — constitutes agreement to these terms. Work will not commence until the quote has been accepted by the client.
3. Payment Terms
Payment is due on completion of the agreed work unless other arrangements have been made in writing. We accept bank transfer, credit card, and cash. For larger projects, progress payment arrangements may be agreed in advance.
Overdue accounts may incur interest at the rate of 2% per month calculated from the due date. The client is responsible for any reasonable costs incurred in the recovery of outstanding amounts.
4. Client Responsibilities
The client agrees to:
- Provide safe and reasonable access to the worksite
- Inform us of any known underground services (gas, water, electricity, telecommunications) prior to commencement of work
- Obtain any required council approvals or permits before work begins, unless otherwise agreed
- Ensure people, pets, and vehicles are kept clear of the work zone during operations
- Advise us of any changes to site conditions between the quote and the work date
5. Council Permits and Approvals
It is the client's responsibility to obtain any required council permits or approvals before tree work commences. While we can advise on permit requirements and provide supporting documentation, we do not take responsibility for obtaining permits on your behalf unless explicitly agreed in writing. Work performed without the necessary approvals is done at the client's own risk and liability.
6. Insurance and Liability
Certified Tree Service holds comprehensive public liability insurance and workers compensation insurance. Certificates of currency are available on request.
Our liability is limited to the value of the work quoted. We are not liable for damage to underground services that have not been identified and marked prior to work commencing. We are not liable for damage to lawns, garden beds, or surfaces that is an unavoidable consequence of necessary equipment access, provided reasonable care has been exercised.
We are not liable for any damage caused by pre-existing defects in trees, structures, or property that were not visible or reasonably identifiable at the time of assessment.
7. Cancellation
Clients may cancel a confirmed booking with at least 48 hours notice without penalty. Cancellations with less than 48 hours notice may incur a cancellation fee to cover scheduling and mobilisation costs.
We reserve the right to postpone or cancel work due to unsafe weather conditions, equipment failure, or other circumstances beyond our reasonable control. In such cases, we will reschedule at the earliest opportunity at no additional cost.
8. Scope of Work
The scope of work is limited to what is described in the accepted quote. Any additional work requested on site will be quoted separately and requires client approval before proceeding. We will not perform work outside the agreed scope without your consent.
9. Warranties
We warrant that all work will be performed in a professional and workmanlike manner in accordance with relevant Australian Standards (including AS 4373 for pruning). If you are not satisfied with any aspect of the completed work, please contact us within 7 days and we will inspect and rectify the issue at no additional cost.
10. Disputes
In the event of a dispute, both parties agree to attempt to resolve the matter through direct communication in the first instance. If a resolution cannot be reached, the parties agree to engage in mediation before pursuing any legal action. These terms are governed by the laws of New South Wales, Australia.
11. Changes to Terms
We may update these Terms of Service from time to time. The current version will always be available on our website. Continued use of our services constitutes acceptance of the current terms.
